A Federal High Court in Abuja, presided over by Hon Justice O.A Musa has ordered the Imo State House of Assembly, to stop impeachment proceedings against the state deputy governor Prince Eze Madumere pending the hearing of motion on notice filed by the number two citizen.
Prince Madumere had last Friday filed an application before the Federal High Court praying it to halt the impeachment process initiated against him by the House of Assembly.
The judge in granting the application ordered the parties to maintain status quo pending the hearing of the motion on notice even as he declared that any party affected by the order is free to apply to set it aside for good cause.
Similarly, Justice Musa also ruled that parties in the case free to file a written argument addressing the court on its jurisdiction to entertain the subsisting suit even as it adjourned the hearing on the motion on notice to November 27
The Speaker Acho Ihim led House had last week opened impeachment process against Prince Madumere by setting up a six member committee headed by Hon Kennedy Ibe, Obowo State Constituency to investigate and report back within seven days allegations of misconduct levelled against Prince Madumere.
However, only within 48 hours, the committee submitted its report concluding that the deputy governor has case to answer prompting the House to serve a notice of impeachment on him, asking him to defend himself against the allegations against him.
But, the deputy governor had argued he was not properly served the notice and consequently dragged the lawmakers and the state chief judge before the court in Abuja.
